Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Jumo mobile application ("App") provided by YONG FAH YIK, operating as Jumo, a micro-entreprise registered in France (SIREN: 890 357 353) ("we," "our," "us," or "Jumo"). By creating an account or using the App, you agree to be bound by these Terms.
If you do not agree to these Terms, you may not use the App.
1. Eligibility
You must be at least 17 years old to use Jumo. By using the App, you represent and warrant that:
- You are at least 17 years of age
- You have the legal capacity to enter into these Terms
- You will provide accurate and complete information when creating your account
- You will maintain the security of your account credentials
If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Account Registration
2.1 Account Creation
To use Jumo, you must create an account using Google Sign-In or Apple Sign-In. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your information as needed
- Keep your account credentials secure and confidential
- Notify us immediately of any unauthorized access to your account
2.2 Account Responsibility
You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to maintain account security.
2.3 One Account Per User
Each user may only create and maintain one account. Multiple accounts for the same individual are prohibited.
3. Subscription and Payment
3.1 Subscription Plans
Jumo is a subscription-based service offering monthly and annual subscription plans. Pricing is displayed in the App and varies by region. All subscriptions are processed through the Apple App Store, and you will be charged in your local currency according to Apple's pricing for your region.
3.2 Free Trial
New users are eligible for a 14-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, you will automatically be charged for the subscription plan you selected.
3.3 Automatic Renewal
Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. Cancellation must be done through your Apple App Store account settings at least 24 hours before the end of the current period.
3.4 Payment Processing
All payments are processed through the Apple App Store. By subscribing, you agree to Apple's payment terms. We do not store or process your payment information directly.
3.5 Cancellation
You may cancel your subscription at any time through your Apple App Store account settings:
- Go to Settings > [Your Name] > Subscriptions
- Select Jumo and tap "Cancel Subscription"
Cancellation takes effect at the end of your current billing period. You will retain access to the App until the end of the paid period.
3.6 Refunds
All refund requests are subject to Apple's standard refund policy. We do not process refunds directly. To request a refund:
- Visit reportaproblem.apple.com
- Sign in with your Apple ID
- Select "Request a Refund" next to your Jumo purchase
Refunds are granted at Apple's sole discretion.
3.7 No Free Tier
Jumo does not offer a free tier. After your free trial ends, a paid subscription is required to continue using the App.
4. Use of the App
4.1 License Grant
The App is licensed, not sold, to you. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for your personal, non-commercial use.
4.2 Acceptable Use
You agree to use Jumo only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Use the App for any commercial purpose or on behalf of any third party
- Share your account credentials with others
- Attempt to gain unauthorized access to the App, other users' accounts, or our systems
- Use automated tools (bots, scrapers, scripts) to access the App
- Reverse engineer, decompile, or disassemble any part of the App
- Remove, alter, or obscure any proprietary notices in the App
- Upload malicious code, viruses, or harmful content
- Use the App to harass, abuse, or harm others
- Impersonate any person or entity
- Violate any applicable laws or regulations
- Use the App in any way that could damage, disable, or impair our services
- Attempt to abuse the free trial by creating multiple accounts
- Extract or scrape data from the App for any purpose
4.3 Personal Use Only
Jumo is intended for personal use only. You may not:
- Use the App to provide services to third parties
- Resell, sublicense, or distribute access to the App
- Use the App for research, training AI models, or building competitive products
5. AI-Generated Content and Health Disclaimers
5.1 Not Medical Advice
IMPORTANT: Jumo provides nutrition information and wellness guidance through AI-powered tools. This content is for informational and educational purposes only and is NOT a substitute for professional medical advice, diagnosis, or treatment.
You acknowledge and agree that:
- Jumo does not provide medical advice or healthcare services
- The App is not intended to diagnose, treat, cure, or prevent any disease or health condition
- AI-generated nutrition estimates are approximations and may not be fully accurate
- You should always consult with a qualified healthcare provider before making dietary or health changes
- You should seek immediate medical attention for any serious health concerns
5.2 Accuracy Disclaimers
The nutrition data, meal analysis, and AI-generated recommendations provided by Jumo are estimates based on:
- Image recognition technology
- Third-party food databases (OpenFoodFacts, USDA FoodData Central)
- User-provided information
- AI algorithms
We do not guarantee the accuracy, completeness, or reliability of any nutrition data or recommendations. Actual nutritional values may differ significantly from estimates provided by the App.
5.3 No Warranties for Health Outcomes
We make no warranties or representations that:
- Use of the App will result in weight loss, improved health, or any specific outcome
- The nutrition data is error-free or suitable for your specific health needs
- The App is appropriate for individuals with specific dietary requirements, allergies, or medical conditions
5.4 Assumption of Risk
By using Jumo, you acknowledge and accept all risks associated with:
- Relying on AI-generated nutrition estimates
- Making dietary decisions based on App content
- Using the App without consulting healthcare professionals
5.5 Third-Party Content
Food databases and nutrition information from OpenFoodFacts and USDA FoodData Central are provided by third parties. We are not responsible for the accuracy or completeness of this third-party data.
6. User Content and Data
6.1 Your Content
You retain all ownership rights to content you upload to Jumo, including:
- Food photos
- Meal logs
- Chat messages
- Notes and descriptions
6.2 License to Us
By uploading content to the App, you grant us a limited, non-exclusive, royalty-free license to:
- Store and process your content to provide the App's services
- Use your content to improve AI models and App functionality (in anonymized/aggregated form only)
- Display your content back to you within the App
We will never sell your content or use it for advertising purposes.
6.3 Content Privacy
All user content is private by default. We do not share your content with other users or make it publicly available. Content may only be accessed by:
- You, through your account
- Our systems, to provide AI analysis and services
- Our service providers (e.g., OpenAI for AI processing), subject to confidentiality obligations
6.4 Content Responsibility
You are solely responsible for the content you upload. You represent that:
- You have the right to upload the content
- Your content does not violate any laws or third-party rights
- Your content is not harmful, offensive, or inappropriate
6.5 Content Deletion
When you delete content or close your account, we will delete your content from our active systems. However:
- Content may persist in backups for up to 90 days
- Anonymized or aggregated data derived from your content may be retained
- We may retain content if required by law
7. Apple Health Integration
If you enable Apple Health integration:
- You grant Jumo permission to read and write specific health data as described in our Privacy Policy
- You can revoke these permissions at any time through iOS Settings
- We are not responsible for the accuracy of data synced from Apple Health
- You are responsible for managing your Apple Health permissions and data
8. Intellectual Property
8.1 Our Intellectual Property
The App and all content, features, and functionality (including but not limited to software, text, graphics, logos, and AI models) are owned by YONG FAH YIK and are protected by copyright, trademark, and other intellectual property laws.
8.2 Trademarks
"Jumo" and related logos are trademarks of YONG FAH YIK. You may not use our trademarks without our prior written consent.
8.3 Restrictions
You may not:
- Copy, modify, or create derivative works of the App
- Use our intellectual property for any commercial purpose
- Remove or alter any copyright or proprietary notices
9. Third-Party Services
The App integrates with third-party services including:
- Apple App Store (payment processing)
- Google Sign-In and Apple Sign-In (authentication)
- OpenAI (AI processing)
- Apple Health (health data sync)
- OpenFoodFacts and USDA FoodData Central (food databases)
Your use of these services is subject to their respective terms and conditions. We are not responsible for third-party services or their availability.
10. Privacy
Your privacy is important to us. Please review our Privacy Policy (available at heyjumo.com/privacy) to understand how we collect, use, and protect your data. By using the App, you consent to our data practices as described in the Privacy Policy.
11. Account Termination
11.1 Termination by You
You may delete your account at any time by contacting us at contact@heyjumo.com. Upon account deletion:
- Your access to the App will be revoked
- Your data will be deleted according to our Privacy Policy
- Your subscription will be cancelled (no prorated refunds unless required by law)
11.2 Termination by Us
We reserve the right to suspend or terminate your account at any time, with or without notice, for:
- Violation of these Terms
- Abusive or fraudulent behavior
- Use of the App for non-personal purposes
- Creating multiple accounts to abuse free trials
- Engaging in activities that harm our services or other users
- Legal or regulatory reasons
11.3 Effect of Termination
Upon termination:
- Your license to use the App immediately ends
- You must stop using the App
- We may delete your data (subject to legal retention requirements)
- Provisions that by their nature should survive (disclaimers, limitations of liability, indemnification) will continue to apply
12. Disclaimers and Limitations of Liability
12.1 "AS IS" Disclaimer
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The App will be uninterrupted, secure, or error-free
- Defects will be corrected
- The App is free of viruses or harmful components
- Nutrition data or AI-generated content is accurate or reliable
12.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YONG FAH YIK, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, data, or use
- Personal injury or health issues arising from use of the App
- Reliance on AI-generated nutrition data or recommendations
- Errors or inaccuracies in the App
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.
12.3 Basis of the Bargain
You acknowledge that we have set our prices and entered into these Terms in reliance upon the disclaimers and limitations of liability set forth herein, and that they form an essential basis of the bargain between us.
13. Indemnification
You agree to indemnify, defend, and hold harmless YONG FAH YIK, its affiliates, and their respective officers, directors, employees, and agents from and against all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another party
- Your content uploaded to the App
- Any health issues or injuries claimed to result from use of the App
14. Dispute Resolution and Governing Law
14.1 Governing Law
These Terms are governed by and construed in accordance with the laws of France, without regard to conflict of law principles.
14.2 Jurisdiction
Any disputes arising from or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts of France.
14.3 Informal Resolution
Before filing a claim, you agree to contact us at contact@heyjumo.com to attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith.
14.4 Time Limit for Claims
You must bring any claim within one (1) year after the cause of action arises, or the claim is permanently barred.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by:
- Posting the updated Terms in the App with a revised "Last Updated" date
- Sending an email notification to your registered email address
- Displaying a prominent notice in the App
Your continued use of the App after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the App and cancel your subscription.
16. General Provisions
16.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and YONG FAH YIK regarding the App.
16.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
16.3 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
16.4 Assignment
You may not assign or transfer these Terms or your account without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
16.5 No Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights.
16.6 Force Majeure
We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, natural disasters, or government actions.
16.7 Export Compliance
You agree to comply with all applicable export and import laws and regulations. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
17. Apple App Store Terms (iOS Only)
If you downloaded Jumo from the Apple App Store, the following additional terms apply:
17.1 Acknowledgement
You acknowledge that these Terms are concluded between you and YONG FAH YIK (operating as Jumo) only, and not with Apple Inc. ("Apple"). YONG FAH YIK, not Apple, is solely responsible for the App and its content.
17.2 Scope of License
The license granted to you is limited to a non-transferable license to use the App on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you via Family Sharing.
17.3 Maintenance and Support
YONG FAH YIK is solely responsible for providing any maintenance and support services with respect to the App, as specified in these Terms or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
17.4 Warranty
YONG FAH YIK is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you (if any). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be YONG FAH YIK's sole responsibility.
17.5 Product Claims
YONG FAH YIK, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.
17.6 Intellectual Property Rights
YONG FAH YIK, not Apple, is solely responsible for the investigation, defense, settlement and discharge of any claim that the App or your possession and use of the App infringes a third party's intellectual property rights.
17.7 Third Party Terms of Agreement
You must comply with applicable third party terms of agreement when using the App (e.g., you must not be in violation of your wireless data service agreement when using the App).
17.8 Third Party Beneficiary
Apple and Apple's subsidiaries are third party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third party beneficiary thereof.
